    The CMMI Institutes’s Data Management Maturity Model as introduced on fails to deal with technical data rights associated with commercial and non-commercial software products and their coordination with software licenses resulting from private funding, government funding, and mixed funding sources.

    This can be corrected by adding an additional process entitled Data Rights linked to Data Governance and including data rights definitions; liability and risk of false claims charges; commercial and noncommercial software products; unlimited, limited, restrictive, government purpose rights; and copyrights and trade secrets.

    With 80% of software procurements involving COTS products, the importance of Intellectual property and data rights are increasing.
